We can see security guards at most of the institutions, restaurants, hospitals, clinics, schools, malls, companies, factories, multiplexes, Corporate offices, Housing societies, private residences, etc. Demand for security guards is increasing manyfold with every passing year. Due to this scenario, the business of the security agency has become very profitable. Investment in this business is very low, and returns are very handsome.

Registration of security firm

To start a security agency we have to register the firm. For registering a security agency firm, we have to name our company and register this firm by that name.

A firm/company can be registered in 3 different ways:

1. Proprietorship
2. Partnership
3. Private limited

In case you want to be the sole owner of the Security Agency, then register the firm under Proprietorship. In this case, the documentation is also very minimal and the paper processing per year is lesser than that of Partnership and Private Limited.

In case you want to open a security agency in partnership, then you have to register the firm in partnership with a friend, wife, or relative. Documentation in this case is higher than in proprietorship.

In case you want to open a security agency on a large scale, then registration of the firm as a private limited is required. It is for your information that lot documentation is required for the registration of a private limited firm.  A lot of documentation is also required to be done every year. Therefore, it is suggested that in the beginning the security agency should be registered in the Proprietorship or Partnership. The help of a Chartered Accountant (CA) can be taken to register a company.

Any further action can only be taken after registering the firm. Upon registering the firm, the next step is the service tax registration.

GST Registration

A security agency provides services to the customers; therefore, it comes under the service tax. GST registration is necessary to run a security agency. After registering the firm, with the help of a chartered accountant, you can apply for GST registration.

Registration for ESI (Employee State Insurance)

If the number of security guards or workers in the security agency is more than 10, then it is mandatory for the company to register for ESI. ESI is an insurance scheme that provides insurance facilities to the employee. You must register for ESI at the time of opening the security agency as the number of workers increases to more than 10 after some time. Therefore, registration for ESI in the beginning necessary. In addition, get registered in the Labor Court.

Registration for PF (Provident Fund)

Whenever the number of employees in a company exceeds 20, it becomes mandatory for the company to register for the provident fund. You should get PF registration done while opening a security agency.

While opening the Security Agency it is necessary to get mainly the above registrations (firm registration, GST registration, ESI registration, and PF registration). Only after this, you can apply for a security agency license.

Eligibility for Security Agency License

A security agency license is issued under the Private Security Agency Regulation Act 2005, also known as PSARA. All the instructions related to the private security guard agency are given in this act. A private security agency cannot run without a PSARA license. Therefore, it is mandatory to have a private security agency license. The eligibility for a PSARA license is as follows.

1. PSARA applicant should be an Indian resident whose financial condition is sound and not guilty of any crime. For this, verification is done by the local police and the applicant also has to submit a photocopy of ITR (Income Tax Return).

2. The applicant has to sign an MOU with the security guard training institute approved by the state controlling authority which ensures that the security guards training will be conducted under the PSARA Act at the training institute. There is special relaxation in this training for ex-servicemen.

Process for Private Security Agency License

1. For the PSARA (Private Security Agency Regulation Act) license, firstly arrange important documents like company registration, GST registration, ESI, PF registration, PAN card of director, and ITR copy.

2. Sign the MOU (Memorandum Of Understanding) with the Security Guard Training Institute recognized by the State Government for the training of Security Guards and Supervisors.

3. For Police Verification, submit an application in Form-I so that the applicant can be verified by the police.

4. Submit the required form for the PSARA license and the supporting documents mentioned above to the state controlling authority. After this, the controlling authority verifies all the documents, and only after getting the NOC (No Objection Certificate) from the police, PSARA issues the license or can reject the documents in error.
5. The entire process takes up to 90 days to complete all the documents.

6. A PSARA license from one state can operate only in the same state if the security agency wants to operate in any other state, then the applicant has to apply for a PSARA license in another state as well.

7. Private security agency license can be applied for a district, 5 districts, or for the entire state for which fees are different.

License Fee for Private Security Agency

PSARA license fees are given in the table below.

This fee is the same in all states, only in the state of Karnataka, the fee for security agency license for the entire state is Rs 50000 instead of 25000.

For your information, it is informed that the validity of the security agency license is 5 years and after that, the license has to be renewed.

सिक्योरिटी एजेंसी का पंजीकरण

सुरक्षा एजेंसी शुरू करने के लिए हमें फर्म को पंजीकृत करना होगा। एक सुरक्षा एजेंसी फर्म को पंजीकृत करने के लिए, हमें अपनी कंपनी का नाम देना होगा और उस नाम से इस फर्म को पंजीकृत करना होगा।

एक फर्म / कंपनी को 3 अलग-अलग तरीकों से पंजीकृत किया जा सकता है।

1. प्रोप्राइटरशिप
2. साझेदारी
3. प्राइवेट लिमिटेड

यदि आप सुरक्षा एजेंसी के एकमात्र मालिक बनना चाहते हैं, तो प्रोप्राइटरशिप के तहत फर्म को पंजीकृत करें। इस मामले में डॉक्यूमेंटेशन भी बहुत कम है और प्रति वर्ष कागज कार्यवाही भागीदारी और प्राइवेट लिमिटेड की तुलना में कम है।

यदि आप साझेदारी में एक सुरक्षा एजेंसी खोलना चाहते हैं, तो आपको एक मित्र, पत्नी या रिश्तेदार के साथ साझेदारी में फर्म को पंजीकृत करना होगा। इस मामले में डॉक्यूमेंटेशन प्रोप्राइटरशिप की तुलना में अधिक है।

यदि आप बड़े पैमाने पर सुरक्षा एजेंसी खोलना चाहते हैं, तो फर्म को एक प्राइवेट लिमिटेड के रूप में पंजीकृत करना होगा। यह आपकी जानकारी के लिए है कि प्राइवेट लिमिटेड फर्म के पंजीकरण के लिए बहुत सारे दस्तावेज की आवश्यकता होती है। हर साल भी बहुत सारे दस्तावेज की आवश्यकता होती है। इसलिए, यह सुझाव है कि शुरुआत में सुरक्षा एजेंसी को प्रोपराइटरशिप या पार्टनरशिप में पंजीकृत होना चाहिए। कंपनी को पंजीकृत करने के लिए चार्टर्ड अकाउंटेंट (CA) की मदद ली जा सकती है।

 फर्म को पंजीकृत करने के बाद ही आगे कोई कार्रवाई की जा सकती है। फर्म को पंजीकृत करने पर, अगला चरण सेवा कर पंजीकरण है।

जीएसटी पंजीकरण

एक सुरक्षा एजेंसी ग्राहकों को सेवाएं प्रदान करती है; इसलिए, यह सेवा कर के अंतर्गत आता है। सुरक्षा एजेंसी चलाने के लिए जीएसटी पंजीकरण आवश्यक है। फर्म को पंजीकृत करने के बाद, चार्टर्ड अकाउंटेंट की मदद से, आप जीएसटी पंजीकरण के लिए आवेदन कर सकते हैं।

ईएसआई (कर्मचारी राज्य बीमा) के लिए पंजीकरण

यदि सुरक्षा एजेंसी में सुरक्षा गार्ड या श्रमिकों की संख्या 10 से अधिक है, तो कंपनी के लिए ईएसआई के लिए पंजीकरण करना अनिवार्य है। ईएसआई एक बीमा योजना है जो कर्मचारी को बीमा सुविधा प्रदान करती है। सुरक्षा एजेंसी खोलने के समय आपको ईएसआई के लिए पंजीकरण करना होगा क्योंकि कुछ समय बाद श्रमिकों की संख्या 10 से अधिक हो जाती है। इसलिए, शुरुआत में ईएसआई के लिए पंजीकरण आवश्यक है। इसके अलावा, श्रम न्यायालय में भी पंजीकरण आवश्यक है।

पीएफ (भविष्य निधि) के लिए पंजीकरण

जब भी किसी कंपनी में कर्मचारियों की संख्या 20 से अधिक हो जाती है, तो कंपनी के लिए भविष्य निधि के लिए पंजीकरण कराना अनिवार्य हो जाता है। सुरक्षा एजेंसी खोलते समय आपको पीएफ पंजीकरण भी करवाना चाहिए।

सुरक्षा एजेंसी खोलते समय मुख्य रूप से उपरोक्त पंजीकरण (फर्म पंजीकरण, जीएसटी पंजीकरण, ईएसआई पंजीकरण और पीएफ पंजीकरण) प्राप्त करना आवश्यक है। इसके बाद ही आप सुरक्षा एजेंसी लाइसेंस के लिए आवेदन कर सकते हैं।

सुरक्षा एजेंसी लाइसेंस के लिए पात्रता

एक सुरक्षा एजेंसी लाइसेंस निजी सुरक्षा एजेंसी विनियमन अधिनियम 2005 के तहत जारी किया जाता है, जिसे PSARA के रूप में भी जाना जाता है। निजी सुरक्षा गार्ड एजेंसी से संबंधित सभी निर्देश इस अधिनियम में दिए गए हैं। एक निजी सुरक्षा एजेंसी बिना PSARA लाइसेंस के नहीं चल सकती। इसलिए, निजी सुरक्षा एजेंसी का लाइसेंस होना अनिवार्य है। एक PSARA लाइसेंस के लिए पात्रता इस प्रकार है।

1. PSARA आवेदक एक भारतीय निवासी होना चाहिए जिसकी वित्तीय स्थिति सुदृढ़ हो और वह किसी अपराध का दोषी न हो। इसके लिए स्थानीय पुलिस द्वारा सत्यापन किया जाता है और आवेदक को आईटीआर (आयकर रिटर्न) की एक फोटोकॉपी भी जमा करनी होती है।

2. आवेदक को राज्य नियंत्रण प्राधिकरण द्वारा अनुमोदित सुरक्षा गार्ड प्रशिक्षण संस्थान के साथ एक समझौता ज्ञापन पर हस्ताक्षर करना है जो यह सुनिश्चित करता है कि प्रशिक्षण संस्थान में PSARA अधिनियम के तहत सुरक्षा गार्ड प्रशिक्षण आयोजित किया जाएगा। पूर्व सैनिकों के लिए इस प्रशिक्षण में विशेष छूट है।

सुरक्षा एजेंसी लाइसेंस के लिए आवश्यक दस्तावेज

1. निगमन प्रमाण पत्र (स्वामित्व, साझेदारी, निजी सीमित मामला जैसा भी हो)
2. प्रशिक्षण संस्थान के साथ समझौता ज्ञापन

निजी सुरक्षा एजेंसी लाइसेंस के लिए प्रक्रिया

1. पीएसएआरए (निजी सुरक्षा एजेंसी विनियमन अधिनियम) लाइसेंस के लिए, पहले कंपनी पंजीकरण, जीएसटी पंजीकरण, ईएसआई, पीएफ पंजीकरण, निदेशक का पैन कार्ड और आईटीआर कॉपी जैसे महत्वपूर्ण दस्तावेजों की व्यवस्था करें।

2. सुरक्षा गार्ड और पर्यवेक्षकों के प्रशिक्षण के लिए राज्य सरकार द्वारा मान्यता प्राप्त सुरक्षा गार्ड प्रशिक्षण संस्थान के साथ समझौता ज्ञापन (समझौता ज्ञापन) पर हस्ताक्षर करें।

3. पुलिस सत्यापन के लिए, फॉर्म -1 में एक आवेदन जमा करें ताकि आवेदक का पुलिस द्वारा सत्यापन किया जा सके।

4. पीएसएआरए लाइसेंस और राज्य नियंत्रण प्राधिकरण के ऊपर उल्लिखित सहायक दस्तावेजों के लिए आवश्यक फॉर्म जमा करें। इसके बाद, नियंत्रण प्राधिकरण सभी दस्तावेजों को सत्यापित करता है और पुलिस से एनओसी (अनापत्ति प्रमाण पत्र) प्राप्त करने के बाद ही, पीएसएआरए लाइसेंस जारी करता है या गलत होने के मामले में दस्तावेजों को अस्वीकार कर सकता है।

5. सभी दस्तावेजों को पूरा करने के लिए पूरी प्रक्रिया में 90 दिन लगते हैं।

6. एक राज्य से एक पीएसएआरए लाइसेंस केवल उसी राज्य में संचालित हो सकता है यदि सुरक्षा एजेंसी किसी अन्य राज्य में काम करना चाहती है, तो आवेदक को दूसरे राज्य में भी पीएसएआरए लाइसेंस के लिए आवेदन करना होगा।

7. निजी सुरक्षा एजेंसी लाइसेंस एक जिले, 5 जिले या पूरे राज्य के लिए लागू किया जा सकता है जिसके लिए शुल्क अलग – अलग है।

निजी सुरक्षा एजेंसी के लिए लाइसेंस शुल्क

 PSARA लाइसेंस फीस नीचे दी गई तालिका में दी गई है।

यह शुल्क सभी राज्यों में समान है, केवल कर्नाटक राज्य में, पूरे राज्य के लिए सुरक्षा एजेंसी लाइसेंस का शुल्क 25000 के बजाय 50000 रुपये है।
